The Divorce Process in Texas
At least one of the divorcing spouses must have been a resident of Texas for at least six months prior to filing for divorce and a resident of the county for at least 90 days. The process has many steps and takes about 60 days from the time the petition is filed for a divorce to become final. Texas has fault and no-fault grounds for divorce.
The grounds for fault divorce include:
- Cruel treatment
- More than one year of incarceration
- Three years or more of confinement to a mental hospital
All property acquired during the marriage is equally owned by both spouses. In most situations, the marital property will be split equally between the spouses.
