What Is the Divorce Process in Texas?

At least one of the divorcing spouses must have been a resident of Texas for at least six months prior to filing for divorce and a resident of the county for at least 90 days. The process has many steps and takes about 60 days from the time the petition is filed for a divorce to become final. Texas has fault and no-fault grounds for divorce.

The grounds for fault divorce include:

  • Adultery
  • Abandonment
  • Cruel treatment
  • More than one year of incarceration
  • Three years or more of confinement to a mental hospital

All property acquired during the marriage is equally owned by both spouses. In most situations, the marital property will be split equally between the spouses. However, certain factors may influence the division of property in a divorce. Property that is acquired prior to the marriage, was inherited, or received as a gift is not considered to be community property.
